Terms of service

1. General provisions

1.1. These Terms and Conditions (Terms) govern the legal relationship between the buyer of goods (Buyer) and SIA Eventure (Seller), reg. no. 40103761635, VAT no. LV40103761635, Vienības gatve 18A, Rīga, LV-1004, Latvia, which operates the online stores www.berghoff.lv, www.berghoff.lt, www.berghoff.ee, www.berghoff.fi, www.berghoff.se, www.berghoff.dk (Online Store).
1.2. These Terms apply to all purchases made in the Online Store. By placing an order, the Buyer confirms that they have read and agree to the Terms.
1.3. The Seller may change the Terms at any time by publishing them in the Online Store. Changes take effect upon publication and do not apply to orders already placed.

2. Products and prices

2.1. All products in the Online Store are described with images and specifications. Images are for illustration; actual products may differ slightly.
2.2. Prices include VAT and are shown in the currency of the selected country (for example euros, Swedish kronor or Danish kroner). Delivery costs are shown separately at checkout.

3. Order and payment

3.1. Orders are placed in the Online Store by selecting products, filling in the order form and completing payment.
3.2. The order is confirmed after full payment through the secure payment providers Shopify Payments or MakeCommerce.
3.3. If the Seller cannot fulfil the order (for example, the product is unavailable), the amount paid is refunded within 3 business days.

4. Delivery

4.1. The Seller delivers to the countries and with the delivery options described in the Shipping policy. The available options and prices are shown at checkout.
4.2. Delivery times depend on the country and delivery option; in Latvia, Lithuania and Estonia delivery usually takes 1–2 business days from order confirmation. In rare cases delivery may be delayed, and the Buyer will be informed.
4.3. The Buyer is responsible for providing accurate delivery details. The Seller is not liable for delays or losses caused by incorrect details.
4.4. On receipt, the Buyer should check the package and the goods. If they are damaged, the courier must be informed and the damage recorded.

5. Right of withdrawal and returns

5.1. The Buyer may withdraw from the purchase within 14 days of receiving the goods without giving a reason.
5.2. To withdraw, the Buyer sends a written notice or the withdrawal form (see the Refund policy) by email to info@berghoff.se.
5.3. The goods must be unused, in their original packaging and complete.
5.4. The refund is made within 14 days of receiving the withdrawal notice; the Seller may withhold it until the goods, or proof that they have been sent back, have been received.
5.5. The Buyer pays the cost of returning the goods unless they were delivered damaged or incorrectly.

6. Warranty and complaints

6.1. Products are covered by the manufacturer's warranty, where provided. This does not affect the Buyer's statutory rights for goods that do not conform to the contract (in the EU at least two years from delivery).
6.2. If a defect is found, the Buyer contacts the Seller by email with a description and photos.
6.3. Complaints are reviewed within 14 days. The Seller may request additional information or the return of the product.

7. Personal data protection

7.1. The Buyer's data is processed in accordance with the Seller's Privacy Policy and applicable data protection law.
7.2. Data is used only for processing orders, issuing invoices and customer service.

8. Limitation of liability

8.1. The Seller is not liable for damage caused by force majeure, delays of logistics partners or actions of third parties.
8.2. The Seller is not responsible for consequences of incorrect data provided by the Buyer (for example, a wrong address).

9. Dispute resolution

9.1. Disputes are first resolved by negotiation. If no agreement is reached, the dispute is resolved by the courts of the Republic of Latvia. This does not deprive consumers of the protection of the mandatory laws or the courts of their country of residence.
9.2. The Buyer may contact the Consumer Rights Protection Centre of Latvia (PTAC, www.ptac.gov.lv) or, for cross-border purchases, the European Consumer Centre in their country of residence.
